Terms and conditions for using next2u marketplace services.

Welcome to next2u, a classifieds service that connects sellers and buyers.

The next2u Terms of Use ("Terms") govern the relationship between next2u S.à r.l. - S. ("Company," "we") and Internet users who access next2u ("users," "you"). You may use next2u in accordance with these Terms and the Privacy Policy. If you do not agree with them, you must stop using next2u.

In short: next2u is a classifieds platform that connects buyers and sellers. We are not a party to transactions between users; you deal at your own risk. You are responsible for your account, your content, and lawful use. We may verify accounts and moderate content (including with AI). Luxembourg law applies.

What next2u is

next2u is available across the next2u.io subdomains (for example market.next2u.io and services.next2u.io). It consists of intellectual property objects owned by the Company and information (user and administrative content) ("next2u").

next2u is an electronic catalog of listings for goods and services (collectively, "goods"), which users can offer and search for on next2u to make transactions. A dedicated vehicles marketplace is being introduced and is not yet open to listings.

The Company provides authorized users with the technical capability to post information on next2u in the format of listings within the provided product categories. The Company grants all users (regardless of authorization) the technical ability to search for and view listings on next2u for the purposes outlined in these Terms. next2u's automated algorithms process requests to provide relevant information in search results.

The Company is not a party, organizer, buyer, seller, employer, intermediary, agent or beneficiary in transactions between users. Users transact at their own risk, independently assessing completeness, reliability, accuracy and legal compliance, without participation or control by the Company.

Creating an account

You may register on next2u using an email address or through your social network profile available in next2u's login form. After registration, we create your unique account. Only one account per email address can exist at a time.

If you register via a social network, some features may be limited. To access all available services, we may ask you to provide an email address and a password.

By registering on next2u and each time you log in, you confirm that you have all the necessary legal capacity to enter into and comply with these Terms.

Logging in

You may log into your next2u account using the email address linked to your account or through a linked social network ("login credentials"). In the first case, you must enter a password; in the second, you must first log into the respective social network.

You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized access, notify us immediately. You may not sell, rent, or transfer your login credentials to third parties. All actions performed on next2u under your credentials are considered to be carried out by you, and you bear full responsibility for them.

Your information and verification

The information you provide to the Company about yourself must be reliable, up-to-date, and must not violate the law or the rights of third parties. You are obliged to update it in your account on next2u as necessary. We may use such information to verify compliance with next2u rules.

All personal data processing is conducted in accordance with the GDPR (EU Regulation 2016/679) and our Privacy Policy. You have rights under the GDPR including access, rectification, erasure, restriction of processing, data portability, and the right to object.

We cannot guarantee that all the information that users provide on next2u is true. Exercise caution when making transactions.

We do not disclose user information to third parties, except in cases stipulated by the legislation of the Grand Duchy of Luxembourg and GDPR requirements (for example, at the request of authorized government agencies or to comply with legal obligations under Article 6(1)(c) GDPR). We cannot be held liable for third-party illegal actions in relation to information that you have independently posted on next2u and made available to other users.

By registering and each time you log in, you consent (GDPR Article 6(1)(a)) to our partners processing information about you as a communications subscriber (including phone number and device information) and sharing the results with us, and to the Company sharing your phone number with partners to confirm your reliability as a next2u user. Partners will not share information that constitutes a secret of communication. This confirmation lets the Company give you the technical ability to create an account and post information, protect other users, and prevent violations. You may withdraw this consent at any time by contacting customer support, though it may affect your access to certain features.

We analyze how you use next2u to make it better, help measure the effectiveness of our services, and recommend next2u services to you.

Your content

User content is the text, images, and videos that next2u users post in listings, the public part of their profile, and reviews. The purpose of posting it is to establish contact with a potential buyer interested in a listing; posting is permitted for informational purposes only.

You are the owner of all the information that you post on next2u. You independently create, modify, publish to an unlimited number of people, and delete content (including personal data) without our participation or approval. The Company is not responsible for user content and does not act as its distributor.

If you publish your personal data in your public profile or listings so users can contact you, you disclose it yourself to an indefinite number of people. The Company processes it to fulfil the agreement with you, the next2u Terms of Use (GDPR Article 6(1)(b)).

If you post third parties' personal data on next2u, you guarantee compliance with all applicable GDPR requirements, including the necessary consents (Article 6(1)(a)) or other legal grounds (Article 6). You remain fully responsible for that compliance.

You must ensure your content complies with applicable laws, these Terms, the rules for posting listings, and profile and review requirements, and that it does not violate the rights of third parties, including intellectual property rights.

next2u is not obliged to conduct a preliminary check of user content; we act on content based on requests or decisions of authorized persons under Luxembourg law.

To keep next2u safe and lawful, we use automated tools, including AI-based moderation, to detect content that may breach these Terms or the law. Content may be reviewed, restricted, hidden, rejected or removed, and accounts may be limited. Where such a decision significantly affects you, you may request a human review by contacting customer support. See our Privacy Policy for details.

Collecting, copying or otherwise using user content for purposes not provided for in these Terms is prohibited and may breach the GDPR. User phone numbers and other personal data may not be used for purposes unrelated to purchasing the user's goods, as this would be unlawful processing under the GDPR.

By leaving reviews and responses, you express your subjective opinion about your communication or transaction with another user. It is prohibited to post knowingly false reviews, to review users you are not interested in transacting with, or to produce or order "cheating" reviews (including paid reviews that inflate a seller's rating).

You grant the Company a non-exclusive licence to use your content and the intellectual property in it: in perpetuity, without remuneration, in any way, worldwide, with or without crediting the author. We may use it to fulfil the Terms, improve next2u, and for advertising and educational purposes, in commercial and non-commercial projects, and may keep archive copies.

Messaging between users

Authorized users can write messages on next2u to discuss products and transaction terms. Using messages for any other purpose is prohibited, including moving the conversation to other messengers or channels by sending links to other sites, resources and services.

Messaging users for purposes not provided for in the Terms breaches the GDPR and personal-data law and causes losses to the Company, and may constitute unlawful processing under GDPR Article 6.

We have the right to record, decrypt, analyze and store messages on next2u based on our legitimate interests (GDPR Article 6(1)(f)). Messages on next2u are not private correspondence. We may review them to ensure compliance with these Terms, the rules for posting listings and other next2u rules, to prevent violations and unfair actions, and to improve next2u, for fraud prevention, security and service-improvement purposes.

How we contact you

We may send you:

  • system notifications you cannot unsubscribe from (for example, to confirm registration or inform you about access restrictions);
  • service notifications related to your actions (for example, a message from another user, actions on your listing, or personalized selections);
  • marketing and informational notifications (tips, invitations to research, promotions and news).

We may reach you in your account's notification center, by email or phone, by push notification, and in messages on next2u. In some cases we may call you to improve the service or provide support, and may involve specialized partners for this.

You can manage service, informational and marketing notifications in your account settings (settings may vary by device). Under GDPR Article 21, you may object to direct marketing at any time, and we will stop such processing on request.

You grant the Company a non-exclusive licence to use the materials in your requests to us (including any intellectual property): in perpetuity, without compensation, in any way, worldwide, with or without crediting the author, solely to fulfil these Terms and improve next2u and the user experience.

Deleting your account

You may delete your next2u account at any time through your settings or by contacting support, exercising your right to erasure under GDPR Article 17 ("right to be forgotten"). If you have not used your account for three years, we may delete it automatically.

Upon account deletion, we process your personal data in accordance with our retention obligations under applicable law and GDPR Article 17(3). For retention periods and deletion procedures, see our Privacy Policy.

Intellectual property

The Company owns the exclusive rights to next2u's software, databases, graphical interface design, trademarks, and other intellectual property elements. Unauthorized use of next2u's intellectual property is prohibited.

We have the right to automatically apply next2u logos/watermarks to the photos you upload to protect the materials in our databases from unauthorized copying. The verbal designation "next2u" is protected as a trademark belonging to the Company.

Licence to use next2u

We grant users a non-exclusive licence to use the databases and computer programs necessary for using next2u for the purposes specified in the Terms. No fee is charged. The licence is granted from the moment of access and lasts as long as you use next2u. Searching and viewing listings is available to everyone; to access other functionality you need to log in.

Without the Company's consent, it is prohibited to use technical means that bypass the normal procedure for using the databases and programs, in particular automated scripts to collect information or register accounts.

Without the Company's consent, it is prohibited to use the databases and programs for purposes not specified in the Terms. This means you may not extract materials from the databases or reuse them in any form or volume, unless directly related to concluding a transaction on a listing. For example, you may not use next2u data to fill third-party databases, or use phone numbers from next2u to call users with offers. Such actions violate the Company's exclusive rights and users' intellectual rights, and constitute unlawful processing under GDPR Article 6, which may result in significant penalties under GDPR Article 83.

Your responsibilities

When using next2u and interacting with the Company and other users, you undertake to:

  • strictly comply with all legal requirements and act in good faith;
  • comply with these Terms, the rules for posting listings, account and review requirements, and other next2u rules and instructions;
  • not contact users if you are not a potential buyer interested in a transaction, and not commit actions that lead to spam;
  • bear responsibility to third parties, including where your actions violate their rights and legitimate interests;
  • not copy information on next2u by automatic means, including user content;
  • not commit illegal acts, and not use images or statements that provoke cruelty, hatred or disrespect, contain threats, insults or defamation, justify or incite illegal or unfair actions, or breach moral or business standards (including obscene or rude language);
  • not use next2u or information posted on it for purposes not provided for in the Terms;
  • not upload or use malicious programs on next2u;
  • not take actions that may interfere with the normal operation of next2u.

Violations and consequences

We strive to make next2u a convenient and safe tool, so we reserve the right to check users' compliance with the Terms at any time and at our discretion, including by automated methods.

We may take measures when we detect violations, preparations for violations, or signs of abuse (for example, manipulating search results, circumventing the rules, or improper use of functionality): restrict access to your account or to some functionality (including temporarily), restrict access to messaging, limit your content in search results, hide a listing on the map, reject or block your content, or restrict access from certain IP addresses and phone numbers.

We may restrict access to an account following complaints from other users; actions that lead to spam; repeated or malicious rule violations; listings or prices that do not match reality; account hacking; failure to provide requested documents or information; false reviews; liquidation of a legal-entity user; signs of fraud; imposition of additional services and conditions; or registering a new account to replace a blocked one.

In exceptional cases, if the user fully eliminates the violations, we may restore access to maintain user loyalty.

We are not responsible for possible losses caused to users by measures taken to prevent and stop violations; we recommend you keep a backup of your content. Violating the law or third parties' rights when using next2u may expose you to administrative, criminal or civil liability.

Reporting illegal content and complaints

In accordance with Regulation (EU) 2022/2065 on digital services (DSA), anyone may report content they consider illegal (a listing, message or profile) using the reporting tools in the interface or by contacting customer support. We acknowledge receipt of reports and review the reported content.

When we restrict, hide or remove a listing or an account, the affected user receives a statement of reasons and may submit a complaint to support to request a review of the decision, including a human review. You may write to us in any of the site's languages.

Ranking, seller status and mediation

Listings are ordered by automated algorithms. The main ranking parameters, together with the labelling of listings promoted for a fee, are described in our Legal notice.

A seller may be a private individual or a professional, according to the status they declare. Consumer law (in particular the right of withdrawal and the legal guarantees of conformity) applies only to purchases made from a professional seller and does not apply to sales between private individuals. See our Legal notice for details.

In the event of a dispute with a professional seller or with next2u in its capacity as a professional, and after a complaint has gone unresolved, you may use a consumer mediator free of charge. The competent mediator by country is listed in our Legal notice. Mediation does not apply to disputes between private individuals.

Final provisions

The provisions on Creating an account, Logging in, Messaging between users, How we contact you, and Deleting your account apply to registered users. All other provisions apply to all users, regardless of registration. Any form of interaction with next2u (including viewing information) confirms your agreement with the Terms. The Company's obligations to provide access are counter to your obligations to comply with the Terms. Certain functionality may be governed by special terms.

next2u functionality may be changed, supplemented or terminated at any time without prior notice. next2u is offered "as is", in the form and to the extent the Company provides it at the time of access. We are not responsible for temporary failures and interruptions or the loss of information they cause. We are not liable for any indirect, incidental or unintentional damage, including lost profits or data, or damage to honor, dignity or business reputation, caused in connection with using next2u. We are not liable for unlawful or unfair actions of third parties who used next2u.

next2u may contain links to third-party websites and offers. We do not control and are not responsible for their availability, content, legality, or the consequences of their use.

All disputes between the Company and users are governed by the legislation of the Grand Duchy of Luxembourg and must be referred to the court with territorial jurisdiction at the Company's location (MAMER), unless otherwise provided by law. You can also send us a written claim to the address below, which we will consider and answer within the legal time limit.
